son of a bitch. finally got nailed. only 4 beers over 1 and 1/2 hrs and blew a .09

so pissed. i was driving perfect but didnt use my turn signal.

now i'm screwed

Pretty much exactly how i got mine. Depending on where you live you, its probably probation for 9 months, no liscense for 3 months, AA classes, a MADD thingy, and basically 1k down the drain. fucking sucks....have fun!

Go downtown and take the blood test, it's your best chance to get off.

Don't you automatically lose your license for a year if you refuse the breathalizer? I know the one they do on the road doesn't count for it, and when you get to the station/jail you have a choice of what one to do. Is that just a rumor that the blood test is gonna be lower?

obv from Kearney, but didn't get the DUI there. Kearney is hella bad on alcohol related offenses. Rumor is that one of the judges had a kid killed by a drunken driver or something

i think you can refuse the breathalizer, but then they autogaffle your license, however they have absolutely no way of proving you've been intoxicated - they definitely cannot force you to undergo any sort of chemical testing - unless bush randomly jewed that constitutional right too

listen if you're ever getting pulled over and are drunk / slightly drunk and have alcohol in the car. jump out of the car and start chugging vodka in front of the cop - ppl beat dui cases like this =)

Tell the officer politely that you know the breathalizer is notorious for false readings, explain to him how you are volunteering to go take the "very accurate" blood test and that you are cooperating 100%. If you blow and fail the sniff test, you are very fucked so what do you have to lose ?

The reason people think the blood test scores you lower is because normally it takes you some time to get to the station and have the test given, that extra time is your friend. Some cops will get pissed, some will tell you lies. Ask yourself what your best chance is

a) blowing here on the side of the road and getting nailed.... very hard to dispute it AFTER the fact.

or

b) take the test that doesn't care if you just burped/puked or consumed something that might trick the sniffer, a test that will tell you the truth especially if you know you had 1 or 2 beers and can't be over the limit.... and again, the extra time is your friend.


Some states may have varying laws about this obv but I have been told by more than one well paid lawyer type that the breathalizer and road side sobriety tests should be avoided at all costs. One stumble on the balance test and it's video evidence against you in court.

Politely inform the officer that you want the test downtown. You have nothing to lose and everything to gain.
